McGill Mediation Services is a business whose aim is to help those involved in disputes to resolve them as quickly, effectively and cost efficiently as possible to everyone’s satisfaction, utilising the skills and knowledge and experience of the parties to the dispute, together with that of their advisors, both legal and otherwise, who are there during the mediation process to advise their respective clients.

So what is Mediation?

Civil and Commercial Mediation is a voluntary, non binding process, conducted on a “without prejudice” basis up to the point of agreement, where information is shared confidentially with a neutral individual who helps the parties to the dispute negotiate a settlement, which is then formalised in writing, and when signed, is then binding on the parties.

Family Mediation

Family mediation is a voluntary, non binding process, conducted on a without prejudice basis by all parties until there is an agreed resolution between the parties. This agreement, when written down, is referred to as a “Memorandum of Understanding”, and may not be legally binding until the parties have received legal advice on the contents of same and it has been formalised by the respective parties legal advisers.

HOW MEDIATION WORKS

Almost any dispute can be mediated, unless for example, a decision on a point of law is required, or one of the parties does not want to mediate or where a Court Order may be required by the parties.

The mediation can be as flexible as required to meet the needs of the Applicant and Respondent parties. Consultations between advisors can be facilitated, for instance between solicitors or engineers as circumstances may dictate
